On 29th November 2023, Seufert Healthcare Partner Dr. Johannes Gruber will speak on the subject of insolvency and restructuring of hospital companies at the FORUM Institut für Management.
Together with other experienced speakers, the subject will be approached from various viewpoints. Seufert Corporate and Healthcare Partner Dr. Gruber who advised, for example, the Cuxhaven und Peine local authority on the rescue of the municipal hospitals out of insolvency, will deal mainly with specifically hospital issues in hospital insolvency, including the following:
- typical constellations, especially private vs.public insolvency (or privatised hospitals),
- specifically relevant contracts and legal relationships, consortial and/or reversion agreements,
- local authority legal aspects of participations,
- continuity of planned admissions and hospital concessions; financing of subsidies and of hospitals, in general,
- aspects of additional care, e.g., guarantees in favour of the VBL or other public or church additional funding institutions,
- distribution of services in the case of group structures (personnel and finance management, accounting/auditing, IT)
- political dimension in threatened closure scenarios and practical challenges e.g., subsequent management
